Limits of Indemnity of up to £25 million may be available for suitable risks.

Public Liability

Where Public Liability is selected, the policy provides indemnity against the insured’s legal liability for damages and claimant’s costs and expenses in respect of:

  • Injury sustained by a person
  • Damage to property
  • Nuisance

The injury, damage or nuisance must happen during the Period of Insurance, within the applicable Territorial Limits and in connection with the insured business.

The policy also provides for defined Legal Costs incurred with the written consent of the insurer in connection with an event that is or may be the subject of indemnity. The exact Limit of Liability is stated in the policy Schedule.

Products Liability

Where Products Liability is selected, the policy provides indemnity against the insured’s legal liability for damages and claimant’s costs and expenses in respect of:

  • Injury sustained by a person other than a person employed
  • Damage to property

The injury or damage must happen during the Period of Insurance and be caused by a product, as defined by the policy.

The policy also provides for defined Legal Costs incurred with the written consent of the insurer.

The total Products Liability limit applying during the Period of Insurance is stated in the policy Schedule.

Additional protection within the wording

Depending on the operative policy sections and subject to all applicable terms, limits and exclusions, the policy wording includes defined extensions relating to matters such as:

  • Sudden, identifiable, unintended and unexpected pollution or contamination
  • Overseas Personal Liability in connection with the business
  • Legal liability under the Defective Premises Act
  • Legal defence costs under the Consumer Protection Act and Food Safety Act
  • Health and Safety at Work legal defence costs
  • Corporate Manslaughter and Corporate Homicide legal defence costs

Flexible underwriting appetite

Subject to full underwriting information, Gem can consider:

Unlimited height and depth limits

Suitable risks involving significant height or depth exposures may be considered without a fixed maximum appetite limit.

Hazardous locations

Work at hazardous or technically complex locations may be considered following an individual assessment.

Temporary EU work

Temporary work in the European Union can be considered, subject to the applicable policy terms and Territorial Limits.

Exports to North America

Products Liability cover operates worldwide excluding the United States of America and Canada as standard.
North American export exposures can, however, be considered by agreement with the insurer and must be confirmed by an applicable endorsement.

Limits up to £25 million

Higher liability limits may be available for suitable risks where required and agreed.

Risk Management

Health and safety support

A specialist health and safety survey may be available for suitable liability risks. The service assesses relevant documentation, business activities and sector-specific challenges before providing practical recommendations. Premium savings of up to 10% may be available where the service is retained, subject to underwriting agreement.

Important cover information

The standard Public and Products Liability wording includes exclusions, limitations and conditions. Among other matters, the standard wording does not provide cover for:

  • The cost of recalling, removing, repairing, replacing or refunding defective products
  • Damage to property owned, hired, leased or otherwise in the insured’s care, custody or control, subject to the detailed policy wording
  • Pure financial loss
  • Liquidated damages, penalty clauses or performance warranties
  • Certain aircraft, marine, offshore and airside exposures
  • Judgments, awards or settlements governed by the laws of the USA or Canada unless specifically agreed
  • Certain asbestos, pharmaceutical, cosmetic and medical-product exposures
