Limits of Indemnity of up to £25 million may be available for suitable risks, subject to underwriting and the applicable policy Schedule.

What the policy covers

Where Employers’ Liability is selected, the policy provides indemnity against the insured’s legal liability for damages and claimant’s costs and expenses arising from injury sustained by a person employed:

  • During the Period of Insurance
  • Within the applicable Territorial Limits
  • Arising out of and in the course of employment by the insured in the business

The policy also provides for defined Legal Costs incurred with the written consent of the insurer in connection with an event that is or may be the subject of indemnity.

The exact Limit of Liability is stated in the individual policy Schedule.

Subject to the individual risk and underwriting agreement, Gem’s appetite can include:

Significant height and depth exposures

The published appetite provides for unlimited height and depth limits, subject to full risk information and underwriting assessment.

Hazardous locations

Work at hazardous locations can be considered where sufficient details of the work and risk controls are provided.

Temporary EU work

Temporary work within the European Union can be considered, subject to the applicable Territorial Limits, terms and endorsements.

Higher Limits of Indemnity

Limits of up to £25 million may be considered where required and agreed by the underwriter including XOL

Supporting better health and safety outcomes

Gem has access to a specialist health and safety survey service for suitable policyholders.
The service is designed to assess relevant documentation, discuss activities and sector-specific challenges and provide practical recommendations.
Where the service is retained, premium savings of up to 10% may be available, subject to underwriting agreement.

Important cover information

The standard Employers’ Liability wording contains terms, conditions, limitations and exclusions. These include exclusions relating to:

  • Liability requiring compulsory motor insurance under road traffic legislation
  • Injury sustained by a person employed while working offshore
  • Certain medical and repatriation costs incurred outside Great Britain, Northern Ireland, the Channel Islands or the Isle of Man

Other policy exclusions, conditions and endorsements may also apply. The policy wording, Schedule and all endorsements must be read together to determine the precise cover applying to an individual insured.
